Agreement With Terms of Use

These Terms of Use state the terms and conditions by which users may use Web sites of ÃÈÃÃÉç (“ÃÈÃÃÉç”). This includes all Web sites with a root URL ending in or containing any variation the URL of “aacte.org” (“ÃÈÃÃÉç Web Sites”). For all purposes, the Terms of Use incorporate and include ÃÈÃÃÉç’s current Privacy Policy.

Other Brand Marks and Brand Names

Brand marks and brand names displayed on ÃÈÃÃÉç Web Sites are the exclusive intellectual property of their respective owners. These items are licensed to ÃÈÃÃÉç but remain the property of their respective owners. The use of any third-party brand mark(s) on any ÃÈÃÃÉç Web Sites is not and shall not be deemed to be ÃÈÃÃÉç’s endorsement of such third party.

Accuracy of Information

Mailing List Rental

ÃÈÃÃÉç rents USPS lists only and does not rent member e-mail addresses. Your rented list file will include the following fields: individual name, individual title, institution name, street address, city, state, zip code, and country. Please note that each rental is good for 2 mailings. Organizations that wish to send more than 2 mailings must re-rent the list.

The materials included in the ÃÈÃÃÉç Web Sites, whether directly or by link and whether directly or indirectly, are provided “as is,” including all faults, errors, and omissions and without warranties of any kind, either expressed or implied. To the fullest extent permissible, pursuant to applicable law, ÃÈÃÃÉç and its affiliates disclaim all warranties of merchantability and fitness for a particular purpose. Security

Users are prohibited from violating or attempting to violate any or all security of the ÃÈÃÃÉç Web Sites.

YOU MAY NOT:

  • attempt to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization

Any action that imposes an unreasonable or disproportionately large load on ÃÈÃÃÉç’s Web Site infrastructure is prohibited. Violations of system or network security may result in civil or criminal liability. ÃÈÃÃÉç will investigate such violations and may involve and cooperate with law enforcement authorities in prosecuting users who are involved in such violations.

Termination of Use

ÃÈÃÃÉç and its representatives reserve the right to deny use of any or all ÃÈÃÃÉç Web Sites to any user for any reason without notification. Consent to Use of Photographic Images and Video Policy

ÃÈÃÃÉç reserves the right to use photographs and video taken at ÃÈÃÃÉç events for marketing purposes including, but not limited to, on social media, on our various websites, and in print and/or e-mail marketing campaigns. By registering for an ÃÈÃÃÉç event, you authorize ÃÈÃÃÉç to use your likeness without additional permission for these purposes.

Other

These Terms of Use and the Privacy Policy shall be governed by and construed in accordance with the laws of the District of Columbia (Washington, D.C.) without regard to its conflict of law provisions. Users agree that any action at law or in equity arising out of or relating to the Terms of Use or the Privacy Policy or to the use of any of the products, services, or content on the ÃÈÃÃÉç Web Sites shall exclusively be filed in the state or federal courts located in Washington, D.C., and users hereby consent and submit to the personal jurisdiction of such courts for all such purposes.

Furthermore, in the event ÃÈÃÃÉç seeks legal action to enforce the provisions of these Terms of Use or the Privacy Policy, the substantially prevailing party in such matter shall be entitled to recover reasonable attorney’s fees and related court costs from any substantially non-prevailing party. If any provision of these Terms of Use or the Privacy Policy shall be deemed to be unlawful, void or for any reason unenforceable, then such limited provision shall be deemed severable from the Terms of Use and/or Privacy Policy and shall not affect the validity and enforceability of any remaining provisions of the Terms of Use and Privacy Policy.

Users agree that regardless of any law or statute to the contrary, any claim or cause of action arising out of or relating to the use of the ÃÈÃÃÉç Web Sites and the Terms of Use must be filed within one (1) year of the date the claim or cause of action arose or be barred as untimely. The failure to insist upon or enforce strict performance of any provision of these Terms of Use shall not be construed as a waiver of any provision or right.

THESE TERMS OF USE, TOGETHER WITH THE PRIVACY POLICY, AS THE SAME MAY BE AMENDED FORM TIME TO TIME, CONSTITUTE THE ENTIRE AGREEMENT BETWEEN YOU AND ÃÈÃÃÉç AND THE ÃÈÃÃÉç WEB SITES RELATING TO THE SUBJECT MATTER CONTAINED HEREIN AND SHALL NOT BE MODIFIED EXCEPT AS PROVIDED HEREIN OR IN WRITING SIGNED BY THE SITE.

In the event of any dispute between the Terms of Use and the Privacy Policy, the provisions of the Terms of Use shall control.
